Q&A's about Disability

Get answers to your questions about Social Security Disability Benefits

How are Social Security disability benefit payments calculated?
Benefit payments are calculated by an evaluation of the amount of money you have paid into the system over your years of employment. During the process of calculating the benefits you will receive, the administration measures certain factors including inflation and changes in the cost of living over your years of employment. The calculation evaluates your payments into the system as far back as 35 years, but you do not need to have paid into the system for that long to be eligible for Social Security disability benefits.

Who decides whether or not I am disabled?
Disability Examiners review all applications and documentation. These are agents that serve the Disability Determination Services (DDS). They review the submission to determine if you are eligible for benefits. The DDS examiners deny a large percentage of claims, and more than half of the individuals who attempt to get benefits are denied. By contacting DDS, it is possible to speak to the Disability Examiner that is handling your submission. A dedicated lawyer from our firm can manage the entire process, including contacting the Examiner to discuss your case, allowing you a much higher possibility of getting your claim paid.

What is the difference between SSDI benefits and SSI benefits?
Social Security disability (SSDI) is paid to those that are disabled and have worked and paid into the system for at least 5 of the past 10 years, but those who are under 22 do not have this work history requirement in pursuing benefits..

Supplemental Security Income (SSI) benefits are paid based upon financial need to both adults and children with disabilities, are blind, and have little income and access to other financial resources SSDI is funded from the Social Security taxes we pay throughout years of employment, and SSI is financed with other sources of tax revenues.

Can you be paid SSI benefits while receiving Social Security benefits after retirement?
If you are receiving SSI benefits through retirement, you could still be eligible for SSI benefits. The amount of the payments will be based upon the amount you receive from your retirement benefits. The amount you will receive in SSI benefits will also be measured against state guidelines regarding income. SSI may allow you access to services such as food stamps, Medicaid, and other types of assistance that may be available to you in your individual situation.
